Expert Support for LPA Registration in the UK

A Lasting Power of Attorney Protects the People You Love When You Cannot Speak for Yourself

Most people put it off. Life is busy, health feels fine, and the paperwork sounds like something to deal with later. But a lasting power of attorney is one of the most protective legal documents you can put in place while you still have the mental capacity to do so, and once that window closes, it is gone.

At Prescient Wealth & Estate Management, we help individuals and families across the UK set up both types of lasting power of attorney, so the right people have legal authority to act when it matters most. More than 1.3 million lasting powers of attorney were registered in the UK in 2025 alone, which tells you this is no longer something only older generations are thinking about.

Whether your concern is your health, your finances, or both, we are here to help you decide the right approach and get everything in place correctly.

Important: Lasting Power of Attorney services are not regulated by the Financial Conduct Authority.

Arrange Lasting Power of Attorney with Confidence

Why Mental Capacity Can Change Without Warning and Why You Cannot Afford to Wait

Mental capacity is not something that only changes in old age. A stroke, a serious accident, or a diagnosis like dementia can affect any person, at any age, and often without much warning. The Mental Capacity Act 2005 defines what it means to lack mental capacity, and once that threshold is reached, you lose the legal right to make your own arrangements.

This matters because without a registered lasting power of attorney already in place, your family cannot simply step in. No family member has the automatic right to access your bank account, decide on your medical treatment, or manage your property and financial affairs on your behalf. That absence of any legal authority forces loved ones into a Court of Protection application, which can take up to 18 months and cost over £1,000 in fees before anything is resolved.

The simple truth is that once you lose mental capacity, it is too late to make a lasting power of attorney. A person must have mental capacity at the time of signing, and the mental capacity act is clear on this point: it has to be done while you still have it.

What Happens to Your Family When No Lasting Power of Attorney Is in Place

What Happens to Your Family When No Lasting Power of Attorney Is in Place

Without a valid LPA, every financial decision and every health decision falls into legal limbo. A bank account cannot be accessed. Bills go unpaid. Property cannot be sold. Medical treatment decisions that should reflect your own decisions and wishes instead get made by clinical teams who do not know you.

For any family member trying to help in that situation, the only route forward is applying to the Court of Protection to become a deputy. That is a formal, slow, and expensive process that a registered power of attorney entirely avoids. A person who needs to take this route can expect to pay significant legal fees just to get started, and the whole thing can drag on for well over a year.

The Two Types of Lasting Power of Attorney and What Each One Covers

There are two distinct types of lasting power of attorney available in the UK, and most people choose to set up both at the same time. Each one gives your chosen attorney a defined area of authority, and each is a separate legal document that requires its own LPA form. It is important to treat each legal document as a standalone piece of planning.

A property and financial affairs LPA allows your attorney to manage your financial decisions on your behalf. This includes access to your bank account, paying bills, collecting pensions and benefits, managing investments, and dealing with your property and financial affairs more broadly. This type of LPA can be used immediately after it is registered, even if the donor still has mental capacity, provided this is specified in the LPA form. Many people choose this arrangement as practical, everyday support.

A health and welfare LPA gives your attorney authority over your medical treatment, daily care, living arrangements, and welfare decisions. A health and welfare LPA can only be used when the donor lacks mental capacity, which means it operates as a safeguard specifically for your most vulnerable moments. Your attorney is expected to act in your best interests at all times and, where possible, to reflect your present wishes when making any decision on your behalf.

Understanding the Health and Welfare LPA

A health and welfare LPA covers the decisions that matter most in a crisis. When a person loses mental capacity, someone needs to be able to speak to health professionals on their behalf and give a clear indication of what the donor would have wanted for their care.

This type of LPA can also include instructions around life sustaining treatment, making it clear whether your attorney can decide to refuse or consent to treatment that is keeping you alive. Health LPAs are registered in exactly the same way as a finance LPA, through the Office of the Public Guardian. Your attorney cannot start acting under this type of LPA until the donor lacks mental capacity, which is one of the key differences between the two types.

Understanding the Property and Financial Affairs LPA

A finance LPA is what most people think of first when they consider what happens to their money if they lose mental capacity or lose capacity due to accident or illness. Your attorney can pay bills, manage your finances, and make financial decisions about your property on your behalf. A financial affairs LPA is a legally binding document. Once the financial LPA is registered, your attorney is authorised to act on your behalf in line with whatever authority the document grants.

Setting up a finance LPA alongside your welfare LPA means your planning covers both the financial and personal sides of your life. You decide whether your attorney is authorised to act straight away or only when you lose capacity, and you set the limits of their authority over your financial decisions. Leaving a gap in your planning, for example having one type but not the other, can still cause serious problems for your family member if something unexpected happens.

Many people choose to set up both at the same time because the LPA form process overlaps and it is simpler and often cheaper to deal with both at once, rather than pay for two separate rounds of preparation and registration.

What the Enduring Power of Attorney System Got Wrong and Why the LPA Replaced It

What the Enduring Power of Attorney System Got Wrong and Why the LPA Replaced It

Before October 2007, the only option available was an enduring power of attorney. The enduring power system had a narrower scope and offered weaker protections for the donor. It did not require a certificate provider, offered less clarity around medical treatment decisions, and provided fewer safeguards overall. A new EPA can no longer be created, and lasting powers of attorney now represent almost 100% of all powers of attorney registered for new applications.

Any existing enduring power of attorney signed before October 2007 remains valid, but no new ones can be made. The Mental Capacity Act was explicit: the lasting power of attorney framework gives donors more control, more protection, and more clarity around how certain decisions should be made on their behalf. Every person who currently has an old enduring power of attorney should also consider whether setting up a lasting power of attorney is a sensible next step. If you were to lose mental capacity tomorrow, an old enduring power may not give your attorney the authority they need to act on health matters at all.

How Prescient Wealth & Estate Management Handles the LPA Process for You

We help with each stage of the process, from completing the forms to registration. Our digital assistance service means you do not need to handle a stack of unfamiliar forms on your own or work out without guidance which options are right for your situation. We walk you through every section of the LPA form, including who to appoint as your attorney, how they should act jointly or independently, what restrictions or preferences you want to include, and how to handle certain decisions that you may want to reserve for a specific person.

One of the most overlooked parts of the process is the certificate provider. This is the person who must sign your LPA form to confirm that you understand what you are signing and that no one is pressuring you into it. The certificate provider must be a professional person, such as a solicitor or doctor, or someone who has known you personally for at least two years. Getting this wrong is one of the most common reasons a power of attorney application gets rejected.

Once your LPA form is completed and signed in the correct order by all parties, we submit it to the Office of the Public Guardian for registration. The average registration time is 8 to 10 weeks. We also use our digital assistance service to keep you informed throughout, and we help you set up an online account with the government portal where required.

When your application is approved, an activation key is issued and the LPA reference number is assigned, confirming the power of attorney is registered and legally active.

How Our Professional Attorneys Handle the LPA Form and Submission on Your Behalf

How We Help With Your LPA Form

One of the most common mistakes people make is attempting to complete an LPA form without support. Over 51,000 power of attorney applications were rejected last year, and many of those rejections came down to a completed form that was signed out of sequence, witnessed incorrectly, or contained contradictory instructions about how attorneys should act.

Our team reviews each LPA form before it is submitted to check that instructions are clear and signing is in the correct order. People fill in these forms thinking they are straightforward, but each section has specific requirements that are easy to miss without guidance.

Each attorney appointed under your LPA needs to understand the limits of what they can and cannot act on, and our team can help you set those out clearly in the document. A person who appoints more than one attorney, for example, needs to decide very clearly how those attorneys should operate together, which our team helps you think through from the start.

Who You Can Appoint as Your Attorney and How to Structure Their Authority

You can appoint more than one attorney, and many people choose to do so. When you appoint more than one attorney, you need to decide how they should work together. Attorneys can act jointly, meaning all must agree on every decision. Alternatively, attorneys can act jointly and severally, meaning each attorney can act independently on certain decisions.

A replacement attorney can also be named within the LPA form. A replacement attorney steps in if your original attorney loses mental capacity themselves, passes away, or can no longer act for any reason. Naming a replacement attorney protects you from the LPA becoming unworkable simply because life gets in the way of the attorney you chose to rely on. Some people also appoint a professional attorney alongside a family attorney to bring an independent perspective to financial decisions.

Within the document you can specify conditions and restrictions on what certain decisions your attorneys can make on your behalf. You can decide that a specific decision requires all attorneys to agree jointly, or that certain decisions can be made by one attorney alone. You can also state your own decisions and preferences as guidance for your attorney, rather than leaving them to interpret your best interests without any context.

Your attorney must always act in your best interests. Acting in your best interests means considering your present wishes, your values, and what you would most likely have wanted if you still had mental capacity. An attorney who does not act in your best interests can be reported to the Office of the Public Guardian. It is also worth noting that any person involved in your care, including medical staff and social services, is legally required to act in your best interests if you lack mental capacity. Attorneys can only make decisions within the scope of their authority, and the Office of the Public Guardian takes seriously any reports of attorneys acting outside of those boundaries.

Understanding the Role of the Office of the Public Guardian in Registering Your Power of Attorney

Understanding the Role of the Office of the Public Guardian in Registering Your Power of Attorney

The Office of the Public Guardian is the government body responsible for registering a lasting power of attorney and overseeing how each attorney behaves once an LPA is in place. Registration is not optional. An LPA form that has not been submitted to and approved by the Office of the Public Guardian has no legal standing, regardless of how carefully it was prepared or signed.

Once the power of attorney is registered, the document is assigned an LPA reference number and added to the government's online verification database. More than 2 million registered LPAs are now part of this online service, which allows banks, health services, and other organisations to confirm attorney authority digitally. This makes it far easier for an attorney to act on behalf of a donor without presenting physical paper documents every time.

A registered LPA is up to date and verifiable. A power of attorney that has been prepared but not submitted is just paper. The LPA registered status is what gives your attorney the legal standing to act. Getting the LPA registered correctly is what we focus on at Prescient Wealth & Estate Management, so it is worth making sure the registration process is completed properly and promptly.

The public guardian also investigates complaints about attorneys who are not acting in a donor's best interests. Any person who suspects an attorney is failing in their duty can contact the Office of the Public Guardian directly. There is a contact centre set up to handle those concerns, as well as general queries about the power of attorney process. Any attorney who is not acting in a donor's best interests can face investigation by the public guardian.

How Much Does a Lasting Power of Attorney Service Cost in the UK?

The application fee for each power of attorney is £92, payable to the Office of the Public Guardian. If you set up both a property and financial affairs LPA and a health and welfare LPA, you pay a total of £184 in government fees. This fee increased from £82 in November 2025.

Professional fees vary depending on who you use. Solicitors typically charge between £400 and £1,000 per LPA document. Online services and specialist providers often charge between £200 and £500 for both LPAs together, before you pay registration fees on top. At Prescient Wealth & Estate Management, our fees are explained in advance.

If you are on a low income with a gross annual income below £12,000, you may qualify for a 50% fee reduction, bringing the cost down to £46 per LPA. Certain benefits may allow you to pay nothing at all, though from February 2026 Universal Credit no longer automatically qualifies. We can explain the options and help you decide whether a reduction applies.

**Please note this is a rough guide and the actual cost will vary based on your financial situation, the complexity of advice required, and the service you choose. We keep an updated price list on our wills & lpa fees page but you need to contact us for an accurate quote.

The Office of the Public Guardian now runs the lasting power of attorney process through a digital system. You can use an online tool to create your LPA form directly, though some people find the questions confusing. The digital system has made the process more accessible, but accessibility is not the same as simplicity.

Our digital assistance service sits alongside this process. We help you use the online service correctly, understand what each section requires, and avoid the errors that cause rejections and delays. If at any point a person would prefer to speak with someone rather than work through an online tool alone, our wills and probate team is available to help.

Advance Decisions, Social Workers and the Limits of What a Power of Attorney Covers

A lasting power of attorney is not the only document that can direct your future care, and it is worth understanding where it fits alongside other planning tools. An advance decision lets you record specific medical treatments you would want to refuse in certain circumstances, even if you were to lose mental capacity. If you have strong feelings about life sustaining treatment, an advance decision can sit alongside your welfare LPA to give your attorneys a clearer picture of your wishes.

It is also worth knowing that social workers, local authorities, and social services each have a role in assessing the needs of people who lose capacity to make their own decisions. In certain situations, social services do not automatically defer to an attorney, particularly in safeguarding cases where a person may be at risk or lack capacity to make their own decisions.

Understanding what your attorney can and cannot decide is part of making sure your planning is complete. We help you think through the advance decision question as part of our service, so every person we work with leaves with a clear picture of all the options and how each piece of their planning fits together.

The Facts Behind Why So Many People Are Now Registering a Lasting Power of Attorney

The Facts Behind Why So Many People Are Now Registering a Lasting Power of Attorney

Nearly one in every two new LPAs registered in 2025 was made by someone aged over 75. Women account for approximately 56% of donors. Registrations have more than doubled over the last decade, rising from fewer than 500,000 per year in 2015 to well over 1.3 million in 2025.

Each person who registers a lasting power of attorney is making an active choice to protect their family and themselves. It is not only older people who lose mental capacity or lose capacity through illness. A lasting power of attorney is a legally binding document that gives your attorney clear, verifiable authority to act, and banks and health providers now recognise a registered LPA quickly.

For any person who has been putting this off, it is worth knowing that the mental capacity act does not make exceptions. You cannot make a power of attorney once you lack the mental capacity to understand what you are signing.
